NY law requires Transportation Network Companies such as Uber and Lyft to insure their drivers through a group policy. These companies must maintain insurance that recognizes that the driver is an Uber or Lyft driver and provides financial responsibility coverage while the Uber or Lyft driver is logged onto the Uber or Lyft network, regardless of whether or not the driver is engaged in a pre-arranged trip. Liability in an Uber or Lyft Accident in New York City

Determining liability after a car accident is always difficult. When the crash involves an Uber or Lyft vehicle, it becomes even more complex. The insurance that provides coverage will depend on available insurance and your status when the crash occurred. 

If the at-fault driver was not the Uber or Lyft driver, rideshare passengers can file a liability claim through the other driver’s insurance company. If you have your own auto insurance, you may also be able to file a claim through your own insurance company. Passengers should always file a no-fault insurance benefit claim with the Uber/Lyft insurance carrier.

Uber car accident claims become trickier when the rideshare driver is at fault. In these cases, the Uber accident policy that applies depends on whether the driver was logged onto the app, if they were going to pick up a passenger, or if a passenger was in the vehicle at the time of the crash.

  • If the driver had not yet turned on the app and you were injured in a crash with the driver, you would have to go through the driver’s personal insurance policy to claim compensation. Under New York’s auto insurance requirements, drivers are required to carry a minimum of $25,000 in liability insurance.
  • If the driver is logged into the Uber or Lyft network but is NOT engaged in a pre-arranged trip, the required minimums of liability coverage are at least $75,000 per person or $150,000 for two or more persons.  They must also carry $25,000 in property damage coverage and standard NY no-fault coverage of at least $50,000.
  • If the driver is logged into the Uber or Lyft network and IS engaged in a pre-arranged trip, the required limits of liability coverage are a single limit of at least $1,250,000 for any and all injured occupants and additional supplementary uninsured/underinsured motorist coverage in the amount of at least $1,250,000 for any person in one accident, in addition to standard NY no-fault coverage of at least $50,000.

In these situations, these coverage requirements may be satisfied by the insurance maintained by the Uber or Lyft driver personally, by insurance provided through a group policy maintained by Uber or Lyft, or by a combination of both.
